المادة 4. الأَعمال غير المَحميَّة
1. لا تُمنَح حقوق التَّأليف والنَّشر لما يأتي:

a) مواد الفُلكلُور والفن التَّقلِيديان;
b) الأَخبار اليوميَّة والمعلومات عن الحقائِق أَو عن أَحداث جاريَّة
c) المُستندات القانونيَّة: التَّشريعات القانونيَّة والمُعاهدَات التَّراجِم الرَّسميَّة لها
d) شِعارات الدُّولة وعلامَاتُها (الأَعلام وشعارات النَّبالة والمِيداليَّات والنَّقد )
e) الخطابات السِّياسيَّة ومُرافعات المَحاكِم
f) البيانات الَّتي نَتجت بوساطة آليَّة دون تدخلٍ إِبداعيٍّ بشريٍّ.
2. لا يجب أَن تُغطِّي حقوق التَّأليف والنَّشر الاكتشافات العلميَّة والأَفكار والمبادِئ والطُّرق والإِجراءات ووجهات النَّظر والأَنظِمة والطُّقوس والنَّظريات العلميَّة والمُعادلات الرِّياضيَّة والرُّسومات الإِحصائِيَّة وقوانين الأَلعاب حتَّى لو كان هناك إِشارةٌ أَو تضمينٌ أَو ذِكرٌ صَريحٌ لذلك في هذه الأعمال.

Article 8. Works that are not Objects of Copyright

  1. Shall not be objects of copyright:
    • formal documents (laws, judgements, other texts of legal, administrative and judicial nature), and also their official translations;
    • state symbols and signs (flag, coat of arms, anthem, awards, banknotes and other signs[1]);
    • works of folk arts, authors of which are not known.
  2. Copyright does not cover ideas, processes, systems, methods of operation, concepts, principles, discoveries or simply information as such, even if they are expressed, reflected, explained or embodied in the work.

  1. ↑ Postage stamps are state signs according to the Article 1 of the Law of the Republic of Belarus No. 258-З of December 15, 2003 on Mail Service (ru) почтовая марка – государственный знак почтовой оплаты, отпечатанный на бумаге и имеющий художественное изображение, а также надписи «БЕЛАРУСЬ», «BELARUS», год выпуска (арабскими цифрами) и номинальную стоимость (арабскими цифрами). Допускается литерное обозначение номинальной стоимости почтовой марки;

Comment – According to interstate and international compacts the Republic of Belarus is the legal successor of the Byelorussian Soviet Socialist Republic, therefore this license tag is also applicable to official symbols and formal documents of the Byelorussian SSR.

Warning – This license tag cannot be applied to proposed official symbols and drafts of the formal documents, which can be copyrighted.

لا يخضع كلٌّ مما يلي لحقوق التَّأليف والنَّشر:

  1. المُستندات الرَّسميَّة (القوانين وقرارات المَحاكِم والنُّصوص الأُخرى ذات الطبيعة التَّشريعيَّة والإِداريَّة والقضائِيَّة) مع ترجماتها الرَّسميَّة;
  2. شِعارات الدُّولة وعلامَاتُها (الأَعلام وشعارات النَّبالة والمِيداليَّات والنَّقد);
  3. الأَعمال الفُلكلورية;
  4. التَّقارير الَّتي تخصُّ أَحداثاً وحقائقَ ذات طبيعةٍ إِخباريَّةٍ.

Article 6. Works Protected by Copyright (subject matter of copyright)

Ideas, methods, processes, systems, means, concepts, principles, discoveries and facts may not be protected by copyright.

Article 8. Works and the Results of Activity Similar to them that Are not Objects of Copyright

The following shall not be objects of copyright:

  • Official documents (laws, resolutions, decisions and etc.) as well as official translations thereof;
  • State emblems and official signs (flags, armorial bearings, orders, monetary signs and etc.);
  • Works of folklore;
  • Information on the news of the day or information on the current events that are of the common press-information character;
  • The results obtained with the help of technical means for the production of a certain type without creative activity of a man directly targeted for creation of an individual work.[1]
