هذه الصفحة سياسة رسمية في ويكيبيديا العربية، ولها قبول واسع بين المحررين وتعتبر معيارا يجب أن يتبعه كل المستخدمين. اشعر بالحرية لتحرير هذه الصفحة حسب الحاجة، لكن رجاءً تأكد بأن تعديلك يعكس الإجماع على هذه السياسة قبل القيام به. |
تهدف ويكيبيديا إلى أن تكون مصدر لمعلومات على شكل موسوعة على أن تكون هذه المعلومات حرة بالكامل تماما. لذا فإن الحرية المعطاة عند التعامل مع الموسوعة شبيهة جدا بالحرية الموجودة عند التعامل مع البرمجيات الحرة. لذا يحق لك نسخ، و تعديل، و توزيع أي جزء من محتويات الموسوعة بشرط أن تحمل هذه النسخ نفس الترخيص، وتعطي نفس الحريات لجميع الأشخاص، وأن تشير للمصدر، أو مؤلفي الوثيقة أو المقال.
و لتحقيق الشروط أعلاه، فإن محتويات الموسوعة تخضع للترخيص الحر للوثائق من جنو. لقراءة هذا الترخيص ويكيبيديا:رخصة الوثائق الحرة.
يجب التقيد بالترخيص أعلاه عند استعمال محتويات الموسوعة. و يجب أن يخضع كل ما يتم إضافته للموسوعة للترخيص الحر. أي إضافة على الموسوعة يتم اكتشاف أنها من مصدر لا يسمح بتطبيق شروط الترخيص الحر للوثائق سيتم حذفها بغض النظر عن المحتوي و القيمة العلمية لها.
لا مانع من وضع وصلات لمواقع لا تخضع للترخيص الحر، على أن تكون هذه الوصلات تساهم في إثراء الموضوع. كما أنه لا مانع من الاقتباس من كتاب أو مصدر على أن يتم الإشارة بوضوح عن مصدر هذا الاقتباس.

[عدل] استعمالك لمواد الموسوعة
إذا أردت أن تستعمل مواد الموسوعة على كتبك أو مقالاتك أو موقع على الانترنت، فإنه يمكنك عمل ذلك ولكن بشرط اتباع سياسة رخصة جنو للوثائق الحرة. إذا قمت بنسخ حرفي لمقالات الموسوعة بغرض تجاري أو غيره، فإنه يجب عليك أن تتبع خاصة الجزء الثاني من رخصة جنو، أي وضع رخصة جنو في كل الصفحات التي تحتوي على المقالات المنقولة، ولا يمكنك وضع رخصتك الخاصة إلى جانبها. إذا قمت بتطوير أو تعديل مادة معينة واستعملتها على موقعك يجب عليك أن تضعها أيضاً تحت رخصة جنو للوثائق الحرة من الآن فصاعداً. مع ذكر صاحب المادة إن وجد.
هناك عدة ترجمات لرخصة جنو للوثائق الحرة، ولكن النص الانجليزي هو النص الأصلي القانونى.
[عدل] استعمالك لمواد خارجية في الموسوعة
إذا ساهمت بمادة سواء مقال أو صورة أو ملف أو غيره بالموسوعة فإنك تسمح باستعمالها تحت رخصة جنو للوثائق الحرة تحت مسؤليتك. من أجل المساهمة في الأساس، يجب أن تكون قادراً على منح ويكيبيديا هذا التصريح، أي تكون :
- صاحب المواد و تملك حقوق النسخ و الحفظ كاملة.
- قد حصلت على تصريح واضح من صاحب المواد، يسمح لك بوضعها تحت رخصة جنو و بحيث يمكن إعادة نسخها، تعديلها و نشرها ضمن عدة أطر منها الأطر التجارية.
في الحالة الأولى، تكون لك ملكية المواد، بإمكانك إعادة نشرها و ترخيصها كما تريد. لكنك لا تستطيع إعادة الحصول على المواد التي وضعتها هنا تحت شروط رخصة جنو، أي إعادة الاستعمال، النسخ ، التعديل، الحفظ و النشر المجاني اللامحدود، لأنه على الأكثر قد تم تعديلها من قبل عشرات المستخدمين على مدار الوقت.
في الحالة الثانية، يجب عليك تزويد الموسوعة و مستخدميها بالتصريح الأصلي الذي حصلت عليه من صاحب المادة، من خلال ربطه ليكون متاح للقراءة من الجميع. يجب عليك أيضا إضافة هذه الملاحظة مع ذكر اسم المادة و صاحبها في الصفحة. إذا أردت الحصول على نص رسالة عامة يمكن استعمالها عند طلب اذن استعمال مواد محفوظة، اضغط هنا.
الرجاء عدم استعمال أي مواد تحمل حقوق النسخ بدون تصريح من صاحب المادة. انك بذلك تقوم بسرقة المحتويات و لا تساعد الموسوعة الحرة ويكيبيديا و إنما تعرضها للخطر و تعرض نفسك للمساءلة القانونية. إذا كنت غير متأكد، ما إذا تلك المواد تقع تحت طائلة حقوق نسخ معينة أو لا، فلا تنسخها بل قم بكتابة المادة بنفسك. سطر واحد مكتوب منك أحسن من مائة سطر منسوخ بدون تصريح.
لاحظ بأن معظم حقوق النسخ تنص على حرية قراءة أو مشاهدة المادة، و لكن ليس على إعادة نسخها. في المقابل، أنه من القانوني أن تقرأ هذه المواد و تعيد صياغتها بلغتك و طريقة كتابك، إعادة الصياغة لا تعني أن تقوم باستبدال كلمة بكلمة، بل تعني إعادة كتابة المقال بشكل جذري. بالنسبة للأشخاص الذين يملكون مهارات لغوية أجنبية، يمكنكم استعمالها من خلال ترجمة المقالات إلى العربية، هكذا قمتم بعمل قانوني مئة بالمئة لأن اللغة الناتجة عن الترجمة تكون مختلفة عن النص الأصلي.
الرجاء عدم الادعاء بأنه لا توجد حقوق نسخ في العالم العربي أو إجمالاً على أي موقع عربي أو في أي كتاب عربي، و أن تسمح لنفسك النقل على مسؤوليتك، ظناً منك أنك بهذه الطريقة تساهم في بناء ويكيبيديا. قد يأتي اليوم الذي ترى فيه نفسك متهما بسرقة مواد محفوظة، أو تجد سمعة الموسوعة تأذت لأن أحد مستخدميها تساهل مع الوضع القانوني لتلك المواد. لا نريد ذلك لنا ولك، بل نريد عامة أن تكون ويكيبيديا موسوعة حرة مجانية فعلاً، ناتجة عن عمل جماعي واعي صادق أخلاقي يحترم القوانين و القواعد ويساهم في بناء المجتمعات و ليس هدمها.
[عدل] الربط بمواد محفوظة
لا توجد مشاكل بعمل وصلات تربط بمواد خارجية ذات حقوق نسخ و طبع، طالما حاولت قدر المستطاع تحديد إذا كانت هذه المواد نفسها تخرق حقوق حفظ لمادة أخرى، أي منقولة أو مستعملة بطريقة غير قانونية. إذا كان الأمر كذلك فلا داعي لربط هذه المواقع بموسوعتنا، مع أن الأمر قد لا يعود بالضرر المباشر من ناحية قانونية و لكن بلا شك سيضر بسمعة الموسوعة.
[عدل] إذا وجدت صفحة على ويكيبيديا تحتوي على مواد ذات حقوق محفوظة
ليس من واجب مستخدمي الموسوعة البحث و مراقبة المواد ذات الحقوق المحفوظة، لكن أقل ما يمكن للمرء عمله إذا شك في إحداها، هو طرح ذلك الشك أو السؤال على صفحة نقاش الصفحة التي تحتوي المادة. الآخرون سيقومون بعمل اللازم إذا استدعى الأمر ذلك. أكبر مساعدة في هذا المجال هو تقديم عنوان الموقع الإلكتروني أو أي شيء آخر والذي يشير لصاحب المادة الأصلي كدلالة على الخرق القانوني للصفحة.
في بعض الأحيان، يكون الأمر سليماً من الناحية القانونية. على سبيل المثال، أن يكون صاحب المادة المحفوظة هو نفسه مساهم في الموسوعة و قد قام هو بنفسه بنشر المواد على ويكيبيديا، أو أنه تلقى مادة نص منسوخة على صفحات أخرى، وقد تكون تلك الصفحات هي التي نقلت المحتوى عن ويكيبيديا. في الحالتين يفضل ذكر ذلك على صفحة نقاش المادة.
إذا تبين بلا شك بأن الأمر يتعلق بفقرة تشكل خرق واضح لحقوق نسخ ما، يتم تنحية الفقرة من الصفحة ، وذكر الحادثة في صفحة النقاش، مع الإشارة إلى النص الأصلي أو عنوانه. إذا تم الحصول لاحقا على التصريح المطلوب للنسخ و الاستعمال الحر تحت ترخيص جنو، يمكن إعادة المواد المحذوفة.
بالنسبة للمقالات الكاملة التي تحتوي مواد محفوظة الحقوق تم نقلها من مصادر أخرى بدون تصريح، فإنه يدرج {{خرق}} في بداية الصفحة مكان النص الموجود، حتى لا يحدث تعارض بين اضافات يمكن أن تحصل تحت ترخيص جنو مع النص الأصلي غير الشرعي، لا تنس ذكر عنوان المصدر إن أمكن. يحق للمديرين حذف هذه الصفحة المخالفة في الحال، إذا رؤوا الحاجة السريعة لذلك دون انتظار نتيجة رد من نسخ المقال.
إذا استمر أحد مستخدمي الموسوعة بنقل مواد ذات حقوق نسخ إلى صفحات الموسوعة بدون الإشارة إلى التصريح أو تعليل هذا الأمر، وبعد تحذيره من قبل المديرين بذلك، فإنه دخوله على موقع ويكيبيديا قد يُجمد لحماية المصلحة العامة للمشروع.
